The type of personal data we hold

We primarily collect contact information such as address, telephone number and email address. We may also collect your birth date to send you offers every year (With your consent).

We may also collect information on your previous visits to our restaurants, as described in 'How we collect information'.

If we receive correspondence from you, we may keep a copy for our records. Similarly, if you apply for a job and send us a CV, we may keep this on file for future reference.

On occasion, we may receive sensitive personal information such as health issues, disabilities or allergies which may necessitate adjustments for your visit to one of our restaurants or offices.

All personally identifiable information is removed from our systems within six weeks after it is no longer needed.

 

How we collect information

We collect information when you contact us by email, telephone, social media, text message or through our website. We also collect information when you book a table, culinary skills class or cocktail masterclass.

You may provide your contact details in person at one of our restaurants, and when you log in to the restaurant wi-fi, along with device details. We also collect information when you complete a feedback form.

 

Information you provide to us about other people

If you provide us with information about any other person - making a booking for someone else, for example - you must ensure you have their consent to pass their details to us. Their information will be treated in accordance with this privacy policy.

 

How we use personal data

Your personal data will be used as necessary to provide our services to you. This includes booking a table or class, processing job applications and complaints, and administering prizes if you win a competition.

With your consent, we will send you marketing messages and promotions. These may include tailored offers based on your previous visits to our restaurants, using information collected via online bookings, wi-fi logins and in the restaurant.

To improve our customer service, we may send you an email 24 hours after you have attended a booking, asking you to complete a feedback form. This information is used to resolve complaints and compile internal reports.

If you specify you are booking for business or corporate purposes, we may contact you to ensure an appropriate level of service, and to discuss future opportunities in our mutual commercial interest.

You may withdraw your consent to our processing of your personal data at any time by using the contact details below. Any marketing messages sent by email have an unsubscribe button in the footer.

 

Access to your information and correction

You have a right to access the personal information we hold about you, and to receive a copy in a commonly accessible format, free of charge. You have a right to transfer that information.

You have a right to ensure any inaccurate or incomplete information is corrected or removed. You may request that we cease processing your personal information, while continuing to store it. You may also request that your personal information is removed from our records.

Usage Rights for your Content

You have been directed to this page as you have either mentioned or tagged Chaophraya on one of your social media platforms.

By mentioning Chaophraya on your social media account you are agreeing to the following:

  • You are an individual ages 18 or older;
  • You own all rights in and to your content and it has not been copied;
  • You have permission from any person appearing in the content to share the content with us for our own use;
  • You waive and will not assert any moral rights that may exist in the content;
  • The content does not breach any third-party rights and does not violate any law;
  • There is no obligation for Chaophraya to use your content;
  • You will not be paid for the use of your content by Chaophraya;
  • That you accept and have read the following terms and conditions.

If you do not agree to the above terms then please do not respond to our request on social media to use #YesChaophraya.

What happens if I respond with #YesChaophraya?

By responding with #YesChaophraya you grant Chaophraya, its affiliates and/or related entities (including Falcon)(together we refer to these as ‘Licenced Parties’) an unlimited, perpetual, irrevocable, royalty-free, worldwide license to copy, reproduce, publish, sub-licence display, perform, distribute, archive, edit, adapt, modify, and otherwise use the photos you share, post or have already posted mentioning “Chaophraya” in connection with any promotional or other activities that they undertake including but not limited to use on its websites, social channels and any promotional campaigns.

This means that by responding with #YesChaophraya, that Chaophraya gets an unlimited right to use the content you have shared, tagged or mentioned Chaophraya as digital or non-digital content. The use includes for example the use of the content on our website, in our restaurants, on our social media platforms, event activations, on emails, and internal communications or on the use of A-boards and posters. We may exercise our rights anywhere in the UK and our licence is perpetual, meaning that it lasts for an indefinite period of time.

Our licence is non-exclusive, meaning that you can stull use your photo for your own purpose and let others use them for their purposes too. In return, you release and discharge Chaophraya from all and any obligation to pay you in connection with our use of your photos as described above and any of the intellectual property rights contained therein for the purposes described in this notice.

You content will be viewed by others and with that you have the opportunity to inspire others with the delicacy that is Chaophraya, from the restaurant settings to the cuisine.

Privacy and the use of your Personal Data

We want to be able to showcase your experiences within the Chaophraya restaurants, and will use your personal data to share user generated content by uploading the imagery that you mentioned Chaophraya in.

What types of personal data do we process?

In reaching out to you about your photos, we will process your personal information which will include your name, social media username [handle or byline], image, caption, physical address if available, email address (if available), IP address and geolocation (if available), together with other identifying information which your content may reveal. If you do not submit your personal data we won’t be able to use your content across our platforms.

Can I change my mind?

Yes, you can simply revoke the granting of these rights to Chaophraya by sending us an email to (marketing@thaileisuregroup.co.uk). You can also contact us to request details of your personal information we hold. You can find more information on your rights in our Privacy Policy.

Limitation of Liability for the Use of Your Content

You agree to release, discharge and agree to hold Chaophraya and any person acting on Chaophraya’s behalf, harmless from all claims, demands, liabilities whatever in connection with the use of your content.

To the maximum extent permitted by law, we exclude all liability in relation to the use of your content as described above.
